General Terms & Conditions.

These General Terms & Conditions (hereinafter referred to as the “Terms”) form a legally binding agreement between you and GetOurStay Private Limited (hereinafter referred to as “GetOurStay”, “We”, “Us”, or “Company”) governing your access to and use of the application / website www.getourstay.com (hereinafter referred to as the “Website” or “Platform”) and any related services, features, content, applications, or tools made available by GetOurStay (collectively referred to as the “Services”).

These Terms shall also apply to all subsidiaries, affiliates, group companies, and entities under the direct or indirect control of GetOurStay, including any services operated or managed by such entities.

By accessing, browsing, registering on, or otherwise using the Website / application and/or Services, you agree to be bound by these Terms and all policies incorporated herein by reference. Your continued use of the Platform constitutes your acceptance of these Terms and creates a legally enforceable agreement between you and GetOurStay.

When you use any specific service offered through the Platform, including but not limited to reviews, listings, subscriptions, communications, or other features, you shall also be subject to the additional rules, guidelines, policies, and conditions applicable to such services. These are deemed to be incorporated into and form an integral part of these Terms.

GetOurStay reserves the right, at its sole discretion, to revise, update, modify, or replace any part of these Terms at any time without prior notice. Any such modifications shall become effective immediately upon posting on the Website. It is your responsibility to review the Terms periodically for updates. Continued use of the Website / application after any changes are posted shall be deemed as your acceptance of the revised Terms.

The Company also reserves the right to suspend, restrict, or temporarily discontinue the operation of the Website / application or any part thereof for maintenance, upgrades, system improvements, or any other operational reason, without prior notice.

1. Definitions

Unless the context otherwise requires, the following capitalized terms shall have the meanings assigned to them below:

“Agreement” shall mean the completed application or registration form submitted by the User, together with any annexures, subscription details, and these Terms. The Agreement shall be deemed to have been executed in Raipur, Chhattisgarh, India.

“GetOurStay” refers to GetOurStay Private Limited, a company duly incorporated under the Companies Act, 2013, having registered office: "Purnima" D-356/5, Tagore Nagar, Raipur- 492001, Chattisgarh, India including its successors, affiliates, and permitted assigns.

“Date of Commencement” means the date on which the User’s application or subscription for Services is accepted or activated by GetOurStay.

“Date of Termination” means the date specified in a termination notice, expiry communication, or the date on which the Services are scheduled to conclude, whichever is earlier.

“Website” or “Application” or “Platform” refers to the official website / application of GetOurStay located at www.getourstay.com, including any mobile version, application, or digital interface operated by the Company.

“My Subscriptions” means the section of the Platform reflecting details of Services subscribed to or availed by the User, including any written communication issued by GetOurStay confirming such subscription.

“Registration Data” refers to all information and details provided by the User at the time of registration or subscription, including but not limited to name, contact information, email address, mailing address, identification details, account credentials, payment information, and any other data submitted to the Company.

“User” or “You” means any individual or legal entity including subscribers, advertisers, property owners, tenants, browsers, visitors, or any other person accessing or using the Website or Services for the purpose of listing, hosting, publishing, viewing, transacting, communicating, or otherwise interacting on the Platform. The term includes their successors and permitted assigns.

“Confidential Information” means any non-public, proprietary, technical, financial, commercial, operational, or business-related information disclosed by GetOurStay or its affiliates, whether oral, written, electronic, or in any other form, including but not limited to trade secrets, business strategies, pricing models, customer data, marketing plans, product information, designs, analytics, and internal processes, whether or not expressly marked as confidential.

2. Services

GetOurStay offers a range of internet-based real estate–related services through its application / website www.getourstay.com (“Platform”), including but not limited to:

Publishing property listings and User profiles for sale, lease, rent, or related real estate services.
Enabling Users to search and explore property listings through the Platform and associated digital links.
Facilitating placement of print advertisements in affiliated publications through the Platform.
Hosting and displaying online advertisements.
Sending promotional or informational communications via email, SMS, or other electronic means.
Any additional services that may be introduced, described on the Platform, or otherwise governed by these Terms.

All Services may be availed through the payment options made available on the Platform and shall be subject to applicable pricing, subscription plans, cancellation policies, refund terms, and other conditions as communicated by GetOurStay from time to time.

3. Eligibility

By accessing or using the Platform, you represent and warrant that:

You are at least eighteen (18) years of age;
You are legally competent to enter into a valid and binding contract under applicable law; and
You possess the authority and capacity to comply with and perform your obligations under these Terms.

Minors may access the Services only under the supervision of a parent or lawful guardian and strictly through the registered account of such parent or guardian.

You agree to complete the registration process prior to uploading any content, listing any property, or availing any Services. You further agree to provide true, accurate, current, and complete information, including but not limited to your name, age, email address, residential address, and contact number. Any misrepresentation may result in suspension or termination of your account without prior notice and/or legal action can be taken.

4. Subscription Fees

The applicable subscription charges (“Subscription Fees”) shall be displayed on the “My Subscriptions” section of the Platform or otherwise communicated to the User by GetOurStay from time to time.

The obligation to pay Subscription Fees shall arise from the Date of Commencement of the subscribed Service.

Users accessing the Platform solely for browsing or posting property requirements for purchase may not be subject to Subscription Fees, unless otherwise specified or notified by GetOurStay.

GetOurStay reserves the right to revise Subscription Fees at its sole discretion. Any changes shall not affect subscriptions already activated unless otherwise stated.

5. Payment and Refund Policy

General Services

For all paid Services:

Fifty percent (50%) of the total order value shall be treated as activation and administrative charges.
The remaining fifty percent (50%) may be eligible for refund on a pro-rata basis, depending on the extent of Service usage at the time of cancellation.

Refunds, where applicable, shall be processed within four (4) to six (6) weeks from the date of receipt of complete and accurate documentation required by GetOurStay.

All refund requests shall be subject to review and approval at the sole discretion of GetOurStay. Approval of a refund in one instance shall not be construed as a precedent or entitlement.

Users are required to make payment of Subscription Fees within the timeline specified in the invoice(s) issued by GetOurStay. Subscription Fees shall become payable upon demand.

In case of any dispute regarding the invoiced amount, the User shall pay the full invoiced amount pending resolution of the dispute. If GetOurStay determines that the User’s claim is valid, any excess amount received shall be refunded without interest.

Delayed payments shall attract interest on the outstanding amount from the due date until the date of actual payment.

All payments made through the iOS application shall be strictly non-refundable under any circumstances, including termination or suspension of Services for any reason whatsoever.

Owner Services

For Services subscribed to by property owners (“Owner Services”):

Subscription Fees shall generally be non-refundable.
If the property is not successfully linked or activated under the purchased package, fifty percent (50%) of the order value shall be retained as activation and administrative charges.
The remaining fifty percent (50%) may be refunded on a pro-rata basis, subject to review.

Refund processing in such cases may take six (6) to eight (8) weeks from the date of submission of all required documentation to GetOurStay.

If at any time a User representing themselves as a property owner is determined to be a builder, broker, or agent, the listing may be deactivated without prior notice, and the entire amount paid may be forfeited at the discretion of GetOurStay.

6. Chargeback Policy

All payments for Services available on www.getourstay.com shall be made strictly on a 100% advance basis unless otherwise agreed in writing.

Upon activation or subscription to any Service, the payment made shall be treated as earned and non-refundable, except where expressly provided under these Terms. Any refund, if granted, shall be at the sole and absolute discretion of GetOurStay.

The User acknowledges and agrees that GetOurStay shall have the right, without prejudice to any other legal remedies available, to adjust, appropriate, or set off any amounts paid by the User against any outstanding dues payable by the User under any other agreement, subscription, or commercial arrangement with GetOurStay.

GetOurStay shall not be responsible for delays, technical errors, or failures in crediting refunds to the User’s bank account, credit card, or payment instrument, as such processes involve third-party banks, payment gateways, and financial institutions beyond the Company’s control.

7. Cancellation Policy

GetOurStay reserves the unconditional right to refuse, suspend, cancel, or withhold publication of any listing, advertisement, or content uploaded on the Platform, without prior notice and without assigning any reason.

Where cancellation is permitted, applicable charges shall be governed by the prevailing Cancellation and Refund Policy of GetOurStay.

Payments made online for any Premium Listing / Discount Packages shall be strictly non-cancellable and non-refundable under any circumstances.

In cases where payment is made via cheque, demand draft, or offline banking channels, cancellation requests shall be considered only if received prior to realization or clearance of such payment.

8. Security

All transactions conducted on the Platform are encrypted using secure technologies.

GetOurStay does not store Users’ credit or debit card details. Payment information is entered directly by the User on secure payment gateway platforms authorized to process such transactions. These payment gateways comply with applicable banking regulations and industry security standards.

The User shall be solely responsible for maintaining the confidentiality of their login credentials, including username and password. Users are advised to periodically update their passwords and refrain from sharing login details with any third party.

Access to Services must be strictly through the User’s registered credentials. The User shall not acquire any ownership rights in relation to mailbox numbers, usernames, IDs, or codes assigned by GetOurStay. The Company reserves the right to modify, withdraw, or reassign such credentials at its discretion without liability.

In the event of loss, theft, or unauthorized use of login credentials, the User must immediately notify GetOurStay via email, WhatsApp, or other official communication channels. The User shall remain responsible for all activities conducted through their account until such notification is received and acknowledged.

Login credentials shall be used exclusively by the registered User or their authorized representatives. Users must take all reasonable precautions to prevent unauthorized access or misuse.

The use of automated tools such as bots, crawlers, or scraping software to extract data from the Platform without prior written consent from GetOurStay is strictly prohibited.

GetOurStay shall not be liable for any fraudulent transactions, unauthorized deductions, or misuse of payment instruments arising from User negligence or third-party breaches beyond the Company’s reasonable control.

9. Obligations and Representations of the User

The User agrees and undertakes as follows:

To provide true, accurate, current, and complete Registration Data at the time of registration and throughout the use of Services.
To acknowledge that all information submitted on the Platform may be subject to verification by GetOurStay.
To obtain, at their own cost, all necessary licenses, permits, approvals, and intellectual property rights required for availing or offering Services through the Platform.
To comply with all instructions, guidelines, and notices issued by GetOurStay in relation to Service usage.
To bear sole responsibility for payment of all applicable taxes, duties, or statutory levies arising from use of the Services.
To be responsible for all data accessed, stored, transmitted, or published using their account.
To maintain confidentiality of login credentials and monitor all activities under their account.
To immediately inform GetOurStay of any unauthorized access, misuse, or breach of security.
To ensure timely payment of Subscription Fees as and when due.
To confirm that they are at least 18 years of age and legally competent to contract.
To arrange and maintain appropriate equipment, internet connectivity, and system configurations necessary for accessing Services.
To acknowledge that property listings may take up to seventy-two (72) hours to become visible on the Platform.

The User expressly consents to the collection, storage, processing, and commercial use of submitted data by GetOurStay, subject to applicable laws including the Digital Personal Data Protection Act, 2023.

The User grants GetOurStay a non-exclusive, worldwide, royalty-free, irrevocable, and sub-licensable license to use, reproduce, modify, adapt, publish, display, and distribute the content submitted by the User (“User Data”) across various media platforms, excluding sensitive financial information.

“Individually Identifiable User Data” refers to information capable of identifying a specific individual, such as name, address, contact number, or email address. All User Data, except sensitive personal information protected under law, shall be deemed licensed to the Platform for lawful use.

The User represents and warrants that:

All submitted information is accurate, lawful, and does not infringe the rights of any third party.
The User holds full rights and authority over the data submitted.
No third-party claims exist in respect of such data.

The User agrees to indemnify and hold harmless GetOurStay from any claims, losses, damages, or legal proceedings arising out of inaccurate, misleading, or infringing content submitted by the User. GetOurStay shall not be liable for disputes relating to alleged data theft, intellectual property infringement, or third-party claims arising from User Data.

10. Prohibited Activities

The User agrees not to:

Permit unauthorized access to the Services or resell, sublicense, assign, or commercially exploit the Platform or listings without authorization.
Use the Services for any purpose other than their intended and subscribed use in compliance with applicable Indian laws and these Terms.
Post, upload, transmit, or store any content that is unlawful, defamatory, obscene, pornographic, paedophilic, abusive, threatening, harassing, libellous, hateful, racially or ethnically offensive, or otherwise objectionable.
Publish content that threatens the sovereignty, integrity, security, or unity of India, harms public order, or incites criminal offences.
Impersonate any individual or entity, falsely represent affiliation, or disclose confidential information without authorization.
Upload viruses, malware, malicious scripts, or attempt unauthorized access to the Platform’s systems or networks.
Use bots, scraping tools, data mining software, or automated mechanisms to extract data without prior written consent.
Print, download, copy, modify, or misuse information belonging to other Users without lawful authorization.
Share false, misleading, deceptive, or malicious information intended to misinform or harm others.
Send unsolicited communications, spam messages, redirect traffic from other platforms, or promote unrelated services to other Users.

Violation of these Terms may result in immediate suspension, deactivation, or permanent blacklisting of the User’s account without notice. GetOurStay reserves the right to forfeit subscription fees as liquidated damages to compensate for losses incurred due to such violations.

11. Intellectual Property Rights and Data Usage

All intellectual property rights in and relating to the application / website www.getourstay.com, including its design, layout, source code, databases, content, features, and Services, shall remain the sole and exclusive property of GetOurStay. No right, title, or interest in such intellectual property is transferred to the User by virtue of accessing or using the Platform.

Any material, content, or information submitted by a User—including text, photographs, videos, reviews, comments, or other media—shall, upon submission, grant GetOurStay full rights to use, reproduce, publish, adapt, distribute, and display such content for lawful business purposes. Unauthorized reproduction, republication, or commercial use of such content elsewhere without prior written consent shall constitute infringement and may result in legal action.

All trademarks, logos, service marks, brand names, and trade dress displayed on the Platform are either owned by or licensed to GetOurStay. No User is granted any license or right to use such intellectual property without express written authorization. Unauthorized usage shall attract strict civil and/or criminal liability.

GetOurStay respects and enforces third-party intellectual property rights and reserves the right to suspend or terminate accounts involved in alleged infringement without prior notice.

Users are granted a limited, revocable, non-transferable, and non-exclusive license to access and use the Services strictly in accordance with these Terms.

GetOurStay reserves the right to collect, process, analyze, and utilize User-provided data for operational, commercial, analytical, and marketing purposes, subject to applicable laws and the Company’s Privacy Policy.

All data submitted by Users may be retained by GetOurStay even after suspension or termination of the account, unless otherwise required by law or agreed in writing.

By providing contact details such as mobile numbers or email addresses on the Platform, Users expressly consent to receive communications, calls, messages, and promotional alerts from GetOurStay, its affiliates, partners, and authorized representatives, regardless of registration under Do Not Disturb (DND) regulations.

GetOurStay may record calls between Users and its representatives for quality assurance, compliance, and dispute resolution purposes.

Users who do not agree with these data usage terms should refrain from submitting their contact details on the Platform.

12. Confidentiality

During the course of using the Platform or Services, the User may receive access to confidential, proprietary, or non-public information relating to GetOurStay, its affiliates, business partners, or other Users.

The User agrees to:

Maintain strict confidentiality of such information;
Not disclose, publish, or share such information with any third party without prior written consent of GetOurStay;
Use such information solely for purposes permitted under these Terms.

Disclosure shall be permitted only where required by applicable law, court order, or regulatory authority.

The User shall implement reasonable safeguards to prevent unauthorized disclosure or misuse of confidential information.

These confidentiality obligations shall survive termination or expiration of access to the Platform.

13. Amendments

GetOurStay reserves the exclusive right to amend, modify, revise, or replace these Terms, including any service-specific guidelines or policies, at any time.

Updated Terms shall be posted on www.getourstay.com, and continued use of the Services after such updates shall constitute deemed acceptance of the revised Terms.

Users are encouraged to review the Terms periodically to remain informed of any changes.

14. Modification, Suspension, or Discontinuation of Services

GetOurStay may, at its sole discretion and without prior notice, add, alter, suspend, or discontinue any part of the Services, either temporarily or permanently.

In the case of paid Services, GetOurStay may, at its discretion, offer a pro-rata refund for any unused portion of the subscription.

The Platform may be temporarily suspended for maintenance, upgrades, testing, or technical enhancements without liability.

GetOurStay shall not be responsible for any direct or indirect loss arising from such modification, suspension, or discontinuation. Unless expressly agreed, no refund or adjustment of fees shall be made in such circumstances.

15. Third-Party Links and Resources in our Services

The Platform may contain links, advertisements, or references to third-party websites, products, or services.

Such third-party content is provided solely for User convenience. GetOurStay does not control or endorse such content and is not responsible for its availability, accuracy, or privacy practices.

Any dealings between the User and third-party providers shall be solely between those parties. GetOurStay shall not be liable for any disputes, losses, non-performance, or dissatisfaction arising from such transactions.

Listing of third-party services or advertisements does not constitute endorsement or affiliation.

If a User enables integration with any third-party service, the User authorizes data sharing necessary for functionality. GetOurStay shall not be responsible for any data misuse, breach, or loss caused by third-party providers.

Users agree to indemnify and hold harmless GetOurStay against claims arising from their interaction with third-party providers.

Refunds for third-party goods or services must be sought directly from the respective provider.

16. Termination and Suspension

Users may request suspension or termination of Services by submitting a written request to GetOurStay. The Company may take up to thirty (30) days to review such request.

GetOurStay reserves the right to immediately terminate or suspend access without notice if it reasonably believes the User has engaged in fraud, misrepresentation, unlawful conduct, or activity detrimental to the Company’s interests.

Upon termination, all amounts paid shall be forfeited and shall not be refundable unless expressly provided.

Provisions relating to confidentiality, limitation of liability, indemnification, and dispute resolution shall survive termination.

17. Suspension for Non-Payment

If any payment due to GetOurStay remains unpaid beyond the stipulated due date, the Company may suspend the Services without prejudice to other remedies.

Suspension due to non-payment may be treated as termination, and the User shall remain liable for all charges incurred until the effective date of suspension.

Reactivation of Services shall be at the sole discretion of GetOurStay upon receipt of outstanding payments and subject to additional terms if applicable.

18. Violation of Terms

In case of violation of these Terms, GetOurStay may:

Remove offending content;
Suspend or permanently disable the User account;
Initiate civil or criminal proceedings;
Seek injunctive relief from a competent court.

GetOurStay may cooperate with law enforcement or regulatory authorities and may disclose User information where required by law.

The Company reserves the right to refuse Services or remove listings at any time without prior notice.

19. Errors, Inaccuracies, and Omissions

The Platform may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, offers, or availability.

GetOurStay reserves the right to correct such errors and update or cancel information or orders without prior notice, even after submission.

The Company is under no obligation to update content except as required by law.

20. Disclaimer and Limitation of Liability

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

GetOurStay does not guarantee:

Uninterrupted or error-free operation of the Platform;
Accuracy, reliability, or completeness of information;
Quality or outcome of leads generated;
Any specific response to listings or advertisements.

The Platform may be subject to technical issues, viruses, or temporary unavailability. GetOurStay shall not be liable for any resulting loss.

GetOurStay acts solely as an intermediary platform under applicable law and does not participate in or guarantee transactions between Users.

Property descriptions, value estimates, expert opinions, and project details are for informational and marketing purposes only. Users must independently verify all information and seek professional advice where necessary.

Real estate investments involve inherent risks. GetOurStay does not provide investment advice, nor does any content on the Platform constitute an offer, solicitation, or recommendation.

Total liability of GetOurStay under any circumstance shall be limited to the total fees paid by the User in the two (2) months preceding the event giving rise to the claim.

Under no circumstances shall GetOurStay be liable for any indirect, incidental, consequential, punitive, or special damages arising from use of the Platform or Services.

21. Limitation of Liability

The User expressly agrees that neither GetOurStay, nor its affiliates, group entities, directors, officers, employees, agents, or representatives shall be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with:

Use of or inability to use the Services;
Cost of procurement of substitute services or products;
Any goods, data, information, or services obtained through the Platform;
Unauthorized access to, alteration of, or misuse of User data or transmissions;
Loss of profits, revenue, goodwill, business opportunity, data, or other intangible losses;
Any interruption, suspension, or discontinuation of Services, whether intentional or otherwise;
Statements, representations, or conduct of any third party on the Platform.

GetOurStay shall not be responsible for any technical malfunction, system failure, or service interruption on the Site or related platforms.

To the fullest extent permissible under applicable law, the User waives any claim for damages for alleged “deficiency of services” under the Consumer Protection Act or other statutes.

In all circumstances, the total cumulative liability of GetOurStay shall not exceed the amount paid by the User to GetOurStay directly in relation to the cause of action.

GetOurStay shall not be liable for internet charges, data usage fees, ISP costs, mobile network expenses, or device-related issues incurred by the User.

The Company shall also not be liable for any malfunction or non-performance of the User’s mobile device, application, or operating system while accessing the Platform.

22. Indemnity

The User agrees to indemnify, defend, and hold harmless GetOurStay, its directors, officers, employees, agents, and Key Managerial Personnel from and against any third-party claims, actions, losses, damages, liabilities, penalties, costs, or expenses (including legal fees) arising from:

Any advertisement, listing, or content posted by the User;
Unauthorized or wrongful posting of property;
Violation of intellectual property rights of any third party;
Breach of any applicable law or agreement in India and foreign countries;
Misrepresentation, fraud, or misleading content submitted by the User;
Use or misuse of the Platform or Services.

This indemnity obligation shall survive termination of the Agreement.

23. Notice and Grievance Redressal

Any complaints, grievances, or concerns regarding content, misuse, or violation of these Terms may be submitted in writing or via email to the designated Grievance Officer:

GetOurStay shall address grievances in accordance with applicable law.

24. Non-Exclusive Remedy

Termination or expiration of the Agreement shall not limit either party’s right to pursue any other remedy available under law.

The User shall remain liable for all fees and charges due up to the effective date of termination.

Termination as permitted herein shall not, by itself, give rise to any claim for damages by either party.

25. Waiver

Failure by GetOurStay to enforce any provision of these Terms shall not constitute a waiver of such provision.

If any clause is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

26. Entire Agreement

These Terms constitute the entire agreement between the User and/or Property Owner and GetOurStay concerning the subject matter herein and supersede all prior communications, understandings, or agreements.

Any modification or waiver shall be valid only if executed in writing by GetOurStay.

Notwithstanding the above, GetOurStay reserves the exclusive right to amend these Terms from time to time.

27. Governing Law and Jurisdiction

Nothing in these Terms shall create any agency, partnership, joint venture, or employer-employee relationship between GetOurStay and the User.

Any claim arising from use of the Platform must be initiated within seven (7) days from the date the cause of action arises, failing which it shall be barred.

These Terms shall be governed by and construed in accordance with the laws of India.

All disputes shall be subject to the exclusive jurisdiction of the courts at Raipur, Chhattisgarh, India.

28. Acknowledgment and Acceptance

By completing registration and/or selecting the “I Agree” or “Agree with Terms & Conditions” option on the Platform, the User acknowledges having read, understood, and accepted these Terms in their entirety.

User feedback regarding violations or improvements may be submitted to GetOurStay to enhance the overall experience of the Platform.

29. Privacy Policy

GetOurStay respects User privacy and is committed to protecting personal information.

User information collected through advertising campaigns or registrations—including property details, names, and contact information—is voluntarily provided and stored in the Platform’s database for lawful business purposes.

The Platform may engage third-party advertising companies to display ads. User data may be shared with related clients strictly for legitimate business purposes.

Unauthorized access or misuse of such data by third parties may result in appropriate legal action.

30. PropWorth Disclaimer

Information and opinions provided on the Platform are for general informational purposes only and do not constitute legal, financial, or investment advice.

While efforts are made to ensure accuracy, GetOurStay does not guarantee completeness or reliability.

Users are advised to conduct independent verification and seek professional advice before making financial or real estate decisions.

All measurements, pricing, and property details are approximate and subject to change.

GetOurStay assumes no responsibility for any error, omission, or misunderstanding in the information presented.

31. Property Description / Measurements Disclaimer

Any misleading or non-standard representation of description / measurements / images / location / any other details shall be the sole responsibility of the User.

GetOurStay acts as an intermediary and disclaims liability for statutory non-compliance by Users.

The Company may remove non-compliant listings without notice.

32. RERA Disclaimer

Developers, promoters, and agents must comply with the Real Estate (Regulation and Development) Act, 2016 (RERA) and provide accurate statutory disclosures.

GetOurStay does not verify RERA registration status and disclaims liability for incorrect or misleading disclosures.

Users / Property Owners are responsible for independent verification via respective State RERA authorities.

GetOurStay acts solely as an intermediary and not as a real estate agent under RERA.

33. Rent Agreement Disclaimer

GetOurStay acts only as a digital facilitator between tenants and landlords.

All dealings are conducted strictly on the principal-to-principal basis.

It does not verify ownership, title, or property condition.

Users are responsible for compliance with applicable state laws including stamp duty and registration.

All orders for rent agreement facilitation are non-refundable unless otherwise determined at GetOurStay’s discretion.

GetOurStay does not verify ownership, title, or physical condition of the property being leased or rented. Users are required to undertake their own due diligence and verification before availing Services.

The User and property owner are jointly and severally responsible for ensuring compliance with all applicable taxes, duties, any law, and other statutory obligation arising out of their transaction. The User agrees to indemnify and hold GetOurStay harmless from any claims, penalties, or liabilities in this regard.

GetOurStay is not a party to any transaction or agreement between the User and property owner and assumes no liability in the event of any dispute between them. The User agrees to fully indemnify GetOurStay from any legal claims, losses or disputes arising from such transactions.

34. Site Visit

GetOurStay facilitates appointment for site visit through our Services between User.

GetOurStay is not liable for any expense incurred or caused for site visit.

GetOurStay does not verify property legality or guarantee transaction outcomes or deals. The role is limited to coordinating the site visit only.

Customer details may be shared with User for coordination purposes.

All decisions and due diligence responsibilities lie solely with the User.

35. Tenant Verification

GetOurStay acts only as an intermediary connecting Users.

The Company does not independently verify tenant / property owner character or credibility.

Users must obtain tenant consent prior to verification.

GetOurStay is not responsible for any loss or cause to property owner or tenant by their transactions / dealings.

Refund eligibility:

100% refund if cancellation is requested within 7 days and before tenant details are shared.
No refund after tenant details are shared or after 7 days.

In exceptional circumstances involving service deficiency, GetOurStay’s maximum liability shall be limited to the amount paid by the User.

36. PG / Property Listing & PG / Property Platform

GetOurStay provides an online platform facilitating interaction between PG / Property Owners and prospective Tenants. GetOurStay does not act as an agent for either party and transactions occur strictly on a principal-to-principal basis.

Users are solely responsible for verifying PG / Property listings, including ownership, condition, amenities, pricing, and legal compliance. Independent due diligence and physical inspection are strongly recommended.

GetOurStay does not guarantee:

Property quality or condition
Legal status or ownership
Availability or services provided by PG / Property Owners

GetOurStay shall not be liable for disputes, claims, or losses arising between Users and PG / Property Owners. Users agree to indemnify GetOurStay against any liabilities arising from such disputes.

GetOurStay may cancel bookings in accordance with its Cancellation Policy. Applicable refunds shall be processed as per the policy in force at the time of cancellation.

The User and the PG / Property owner are solely responsible for any taxes, duties, license compliances or statutory liabilities. The User agrees to indemnify GetOurStay against any liability arising from non-compliance of their part.

Packages purchased may be used for PG / Property or regular listings subject to validity and usage policies.

GetOurStay reserves the right to modify these Terms at any time. Continued usage constitutes acceptance of updated Terms.

37. Legal Services

The Users must independently review and assess legal advice or documentation during finalisation of transaction / deal. Any concerns / dispute / clarification must be settled between them. GetOurStay may assist but shall not be directly liable for service deficiencies.

GetOurStay shall not be a party to disputes between the User and the PG owner / property owner. The User agrees to indemnify GetOurStay against claims arising from such disputes.

In rare cases of non-performance or significant service lapses, GetOurStay may, at its discretion, offer a suitable resolution. Liability shall be limited strictly to refund of the amount paid, if applicable.
